Can a Veterans Lawyer Be Hired Before Applying for Benefits?
|
|
Q: What is the difference between a direct service connection and a secondary one? A: An injury or condition is assigned a direct service connection designation if it is determined to have been caused by time in service. A secondary service connection is assigned to an injury or condition determined to have been caused by another service connected injury or condition. If you are unclear about the service connection provided in your rating decision, speak with a veterans lawyer. He or she will help you review the rating decision and determine the next course of action, should you disagree with any aspect of that decision. Q: Do veterans benefits ever discontinue? A: Veterans benefits will continue as long as the VA determines eligibility for benefits. In some cases, the VA may re-evaluate a claim periodically. After that re-evaluation, benefits might change. Veterans whose cases are reviewed should not be alarmed, but should make sure that the VA has recent and complete medical records and supporting documentation to allow for a fair evaluation. A veteran who currently receives benefits and whose injury or condition changes can also request a new evaluation. If you have questions or concerns about a recent or upcoming evaluation, it would be helpful to speak with a veterans lawyer. A veterans lawyer can help assure that all the necessary supporting evidence is obtained and has been submitted. He or she can also assist you should you disagree with the outcome of an evaluation. Q: When can a veterans lawyer be hired? A: By law, a veteran cannot engage in a fee based contract with a veterans lawyer until the Regional Office has provided a rating decision. The VA will provide assistance to veterans who need help initially applying.
